1. Purpose
The purpose of this Practice Note is to describe the procedure for an applicant who wishes to withdraw their request for review.
2. Background
Once a request for review has been withdrawn, the file is closed.
3. Process
An applicant who wishes to withdraw their application must do so in writing (whether by letter, email, or fax).
When there is an oral hearing, an applicant may withdraw their request for review at any time before the hearing ends.
When there is a written hearing, an applicant may withdraw their request for review before the Tribunal gives its decision.
The Tribunal will then confirm in writing to both parties whether, as a result of the applicant's request to withdraw its request for review, the file has been closed
4. Approval
Practice Note #16 is approved by the Tribunal’s Chairperson on February 23rd, 2023.
